Anecdote on Organization & Justice Goals

My student had been playing catch me if you can with the reservation police after a school day beer party. For hours he and his buddy kept ahead of the patrol car until they ducked into the back of a relative's house full of children who they quickly rushed to the basement. The car drove up out front.

His trial was largely to determine if the officer sprayed bullets across the front of the house before my student fired once with a varmint rifle breaking his windshield. Or after? The officer had lived. My student was found guilty, tried as an adult at 17 while his buddy two months younger would go to juvie. The prosecutor had made much of their rowdy behavior at a basketball game and drinking history; that is what an advocate is supposed to do, get a conviction given contradictory evidence before the law, a law organized to permit the same advocacy to the other side. The prosecutor was effective.

Called for the sentencing phase, I was an inexperienced witness, my only other was in a military trial where the advocates' first goal was to bring out the truth. I thought that would apply to sentencing. No.

I got out his B average, top makeup status, and never seeing him drunk at school. While thinking how to bring out the 'dogsoldier' character of this boy among his schoolmates, giving only yes and no answers, here came the basketball cross. Yes, I'd been there. Yes, I'd seen rowdiness (our whole team actually, since Indian basketball is not an individual sport). My face clouded.

Last answer: No, I hadn't seen my student commit the foul. It looked like I was lying to protect him. In fact, I had been watching two of my more culpable students. My one-time ALJ employer counseled that there was no remedy.

I learned the truth that day, that pursuing only organizational goals can result in justice, but only in the long term, on average. It's been 20 years: I hope he is out now. B. Russell
